Understand Illinois laws and regulations for assisted living facilities

Assisted living communities in Illinois are governed by specific laws and regulations to ensure seniors’ safety, well-being, and rights. It’s important for families and potential residents to be aware of these regulations when considering assisted living communities.

Licensing

In Illinois, assisted living facilities must be licensed. These facilities undergo Life Safety Code/physical environment inspections performed by the Illinois Department of Public Health’s (IDPH) Design and Construction Section as part of the licensing process. IDPH also conducts annual unannounced visits to each establishment to verify compliance with licensure requirements and standards. Any additional visits may occur without advance notice.

Although public access to inspection reports and licenses isn’t directly available online, you or your loved one can submit a Freedom of Information Act request to obtain these records.

Staffing regulations

Staffing in Illinois assisted living facilities is regulated to meet residents’ 24-hour scheduled and unscheduled needs. There must be at least one staff member on duty at all times and one direct care staff member with current certification in CPR for adults.
