Assisted living communities in Illinois are governed by specific laws and regulations to ensure seniors’ safety, well-being, and rights. It’s important for families and potential residents to be aware of these regulations when considering assisted living communities.

Licensing

In Illinois, assisted living facilities must be licensed. These facilities undergo Life Safety Code/physical environment inspections performed by the Illinois Department of Public Health’s (IDPH) Design and Construction Section as part of the licensing process. IDPH also conducts annual unannounced visits to each establishment to verify compliance with licensure requirements and standards. Any additional visits may occur without advance notice.

Although public access to inspection reports and licenses isn’t directly available online, you or your loved one can submit a Freedom of Information Act request to obtain these records.

Staffing regulations

Staffing in Illinois assisted living facilities is regulated to meet residents’ 24-hour scheduled and unscheduled needs. There must be at least one staff member on duty at all times and one direct care staff member with current certification in CPR for adults.

Additionally, each manager and direct care staff member must complete at least eight hours of ongoing training annually, which includes aspects such as resident dignity, disaster procedures, hygiene and infection control, abuse and neglect prevention, and assisting residents with activities of daily living.

Care plans

Every resident in an assisted living facility in Illinois must have a mutually agreed-upon written service plan based on a physician’s assessment and evaluation. This service plan should be developed by the resident (or their representative), the facility’s manager (or a designee), and a registered nurse (if the resident is receiving nursing services or medication administration).

Service plans must be reviewed annually — or more frequently if the resident’s condition, preferences, or service needs change. These plans must also detail the level of service the resident receives, the health-related services needed, the staff responsible for service plan provisions, any risk being negotiated, and medication requirements.
