California laws and regulations for memory care facilities

Memory care communities in California are licensed by the California Department of Social Services (CDSS) and are referred to as Residential Care Facilities for the Elderly (RCFE).[01]

Each memory care community must provide the following to remain licensed in California:[02]

  • Safe and healthful living accommodations
  • Personal assistance and care
  • Observation and supervision
  • Food service
  • Planned activities involving social, leisure, and daily living skills
  • Individual resident privacy in each bathroom
  • Clean and accessible common areas for residents
  • Accessible bedrooms for residents with disabilities

Resident and staff requirements for memory care facilities

All memory care communities in California must follow the following resident and staffing practices:[02,03]

  • Perform resident assessments prior to moving in, which may include a review of health history and an interview with the family and resident.
  • Have adequate staffing at all times to supervise and care for residents.
  • Have at least one staff member awake and on duty at night, regardless of the number of residents.
  • Have another staff member on-call overnight for facilities with more than 16 residents.
  • Provide each staff member at least 6 hours of orientation and 8 hours of dementia-specific training annually.

How to find California memory care facility inspection reports

In California, the CDSS inspects each memory care facility once a year and no later than 10 days after a complaint has been filed.[02] To search for inspection reports, you can use the Care Facility Search on the CDSS website using the following instructions:

  • Scroll to “Search By Facility Group.”
  • Choose “Elderly Assisted Living.”
  • Choose the appropriate “Facility Type” and your county.
  • Click on the search button.

If you would like to access a specific memory care facility’s inspection report, you can also search by facility name or address, if you have that information. Each inspection report includes the following information:

  • Number of inspection and complaint visits
  • Most recent date of inspection
  • Number of citations and complaints
  • Detailed evaluation reports
