Veterans can apply for a VA Pension if they’ve been honorably discharged and meet certain eligibility requirements. Medicaid

Medicaid provides eligible individuals with coverage for institutional long-term care, which includes nursing homes. Medicaid will pay for room and board, nursing care, therapy, medications, and medical supplies.[04] To qualify for Medicaid coverage in Florida, an individual must meet certain eligibility criteria, including financial and nonfinancial requirements.

Unfortunately, Medicaid only covers room and board at skilled nursing facilities. Seniors at assisted living or memory care facilities cannot use Medicaid to cover custodial costs. However, medically necessary services are covered.

In Florida, Medicaid is administered through the Statewide Medicaid Managed Care (SMMC) program by the Agency for Health Care Administration. SMMC comprises three separate programs: the Long-Term Care program (LTC), the Managed Medical Assistance (MMA) program, and the Dental Program.

To access coverage for services provided in an assisted living or memory care facility, you’ll need to utilize waivers. The Home and Community-Based Services Waiver program covers most health care services. Long-Term Care waivers are designed to delay or prevent institutionalization by covering in-home or community health care. And MMA covers doctor visits, mental health care, and more for Medicaid recipients.

Seniors in Florida can access impartial financial counseling through the Serving Health Insurance Needs of Elders (SHINE) program provided by the Department of Elder Affairs and the Area Agency on Aging. The Florida Ombudsman Program is another vital resource for seniors and families who need long-term care support and advocacy.

Medicare

Medicare offers limited coverage for skilled nursing. To qualify for coverage, seniors must meet the following conditions:

  • The senior has days remaining in their benefit period and is enrolled in Part A.
  • The individual has had a qualifying inpatient stay.
  • A physician has determined that daily skilled care is necessary.

Medicare considers assisted living and memory care to be custodial care, so everyday expenses like room and board aren’t covered. However, Medicaid can be used to cover medical services, supplies, and care.

Seniors are eligible for Medicare if they’re 65 or older and have Social Security Disability benefits. To apply online, visit the Social Security Administration website.

Understand Florida laws and regulations for nursing homes

Depending on the type of care community, several laws and regulations are applicable to ensure seniors receive adequate care.

For skilled nursing facilities, state regulations are enforced by the Florida Agency for Health Care Administration, and federal regulations are enforced by the Centers for Medicare & Medicaid Services. Current regulations for nursing homes include:

  • Ensure that each resident maintains the highest possible level of physical, mental, and psychosocial well-being.
  • Conduct an accurate and comprehensive assessment of each resident’s functional capacity. The evaluation must be used to develop a care plan that addresses the resident’s needs and preferences.
  • Provide 24-hour nursing services by licensed nurses.

Assisted living and memory care facilities

Other forms of long-term care, such as assisted living and memory care, must follow regulations set by the Florida Bureau of Health Facility Regulation. In addition to the standard license, some communities may hold specialty licenses such as limited nursing services, extended congregate care, and limited mental health services.

Communities must undergo an initial inspection before receiving a license and are inspected after that at least every two years. The inspection covers staff-to-patient ratios, staff training, resident care plans, and registered nurse staffing levels. All inspection reports are available online on the Florida Agency for Health Care Administration website.

Some additional regulations for memory care include:

  • Having 24/7 staffing capability
  • Providing awake staff at all times if the facility has more than 17 residents
  • Requiring specialized dementia training for staff who provide direct care or have contact with residents who have dementia
  • Requiring yearly dementia-specific training for direct care staff
  • Designing activities specifically for individuals with cognitive impairment
  • Creating care plans no later than 30 days after admission and reviewing them monthly

Both assisted living and memory care facilities are required to provide home-like atmospheres with plenty of staff to care for residents’ needs at all times of day.
