Understand Arkansas laws and regulations for assisted living facilities

All assisted living facilities in Arkansas must be licensed by the state’s Department of Human Services, Division of Medical Services, and Office of Long Term Care.

Assisted living communities are either labeled as “Level I” or “Level II” facilities. Both provide 24-hour supervision, assistance with activities of daily living and help with laundry and medication. The Level II facility provides a greater depth of assistance, as well as health care services.

Regardless of their designated level, however, every facility is meant to promote the health, independence, safety, dignity, and privacy of residents — all while providing services in a comfortable, home-like atmosphere. Additionally, units within assisted living facilities are required to be independent apartments with visually distinct kitchen areas.

It is the expectation that all assisted living facilities will be transparent with potential residents about services, fees, and similar information in any agreements. This includes (but is not limited to) the facility’s refund policies, emergency transfer provisions, and discharge protocols.

Assisted living inspections in Arkansas

All assisted living facilities in Arkansas must submit renewals once per year to the Department of Human Services to maintain their licenses. Additionally, the Office of Long-Term Care completes a survey of all facilities about every 18 months. This includes unannounced inspections as well as complaint investigations.
