How people pay for senior apartments in The Woodlands

Senior apartment communities do not qualify for coverage under programs such as Medicaid, Medicare, or long-term care insurance, as they are not intended to provide medical care. However, seniors residing in senior apartments may receive assistance from these programs for medically necessary in-home care services.

In this section, you’ll learn how private pay options, housing assistance, VA benefits, Medicare, and Medicaid can be used to pay for some costs associated with moving to a senior apartment.

Private pay methods

Seniors often use some form of personal income to cover the expenses associated with renting a senior apartment. These sources can comprise savings, Social Security benefits, investment returns, and pensions, which are frequently combined with additional personal income sources such as:

Seniors can access various VA benefits to help cover the cost of senior apartments. While veterans can use some benefits to cover housing expenses, others primarily cover in-home health expenses.

One valuable benefit is the Aid and Attendance (A&A) benefit, designed to assist seniors who require help with daily activities, are bedridden due to illness or in a nursing home, or have limited eyesight. This benefit is provided as an additional monthly payment to a VA Pension and can help offset the cost of a senior apartment, as it can be used to pay for anything that improves quality of life.

Applying for A&A can be complicated. Whether you think you qualify or not, it’s important to contact VA-vetted representatives to help navigate the application process. A valuable resource to consider using is a local veterans service officer, who can tell you what benefits you might be eligible for and ensure no benefits are left on the table. In The Woodlands, these officers are available through the Montgomery County Veterans Services Office, which provides several services beyond benefits counseling.

For help with claims, veterans can also contact the Austin-based Texas Veterans Commission, which assists people through claims, appeals, and compensation. Locally, Veterans of Foreign Wars (VFW), the American Legion, and Disabled American Veterans (DAV) have chapters that offer support and have veterans service officers, too.

Medicaid

Although Medicaid does not typically cover the cost of rent for senior apartments, it can provide financial assistance for medically necessary in-home health care services. In Texas, Medicaid is administered by the state’s Department of Health and Human Services through the Your Texas Benefits portal.

One of the most common ways to finance in-home health care services in senior apartments in Texas is through the home and community based services (HCBS) waiver program. This program covers various services, including personal care such as dressing and bathing, in-home services like housekeeping and meal preparation, and nursing services such as blood draws. Waivers in Texas include:

  • A-3310 Community Living Assistance and Support Services (CLASS)
  • A-3320 Deaf Blind with Multiple Disabilities (DBMD)
  • A-3330 Home and Community-based Services (HCS)
  • A-3380 STAR+PLUS Waiver (SPW)

While eligibility changes depending on the waiver, typically, a senior must have limited income, be a U.S. citizen or qualified legal alien living in Texas, and be at least 65 years old.[03] Applications for Medicaid are available online at the Your Texas Benefits website.

In Texas, there are five types of Medicaid plans: STAR, STAR+PLUS, STAR Kids, STAR Health, and traditional Medicaid. Coverage depends on where a person lives and their health issues. Texas residents who are unsure about which plan they’re eligible for can call the Texas Enrollment Broker Helpline or log into their Your Texas Benefits account.

Because the application process can be long and complicated, we recommend contacting the Houston-Galveston Area Agency on Aging or the Aging and Disability Resource Center for additional support and guidance. In addition, for those needing advocacy or who have complaints, the Health and Human Services Office of the Ombudsman and the Long-Term Care Ombudsman are on hand to assist.

Medicare

Medicare is a government-run health insurance program designed for individuals aged 65 and above. Despite its similarities with Medicaid, Medicare does not cover rent expenses in senior apartments. However, it can be utilized to cover medical expenses and short-term health care necessities, including:

  • Hospitalization
  • Doctor’s visits
  • Lab tests
  • Medical equipment
  • In-home care

To apply for Medicare coverage, your local Social Security office is the primary destination. To locate the nearest Social Security office, visit the Social Security Administration website, which has an Office Locator. We’ll also provide your local office address in the resources below.

For those who need help navigating the Medicare system or want financial support, several local resources are available on-hand:

  • The Texas Medicare Savings Program helps cover costs like Medicare premiums, deductibles, and co-insurance for those who meet income requirements. Applications can be found through the Your Texas Benefits portal.
  • The Texas Health Information, Counseling, and Advocacy Program offers all Medicare recipients financial counseling and assistance with Medicare enrollment.
  • The Houston-Galveston Area Agency on Aging can help seniors with Medicare by providing counseling and assistance with Medicare benefits and options.

For those who need support, the local Long-Term Care Ombudsman is a trained advocate available to support seniors and their loved ones with grievances and claims.

Public assistance

Housing Choice Vouchers can help eligible low-income seniors in Texas pay for rental housing, including senior apartments. In The Woodlands, this program is run by the Montgomery County Housing Authority and has limited spots. The Housing Choice Voucher operates on a lottery system.

Not all senior apartments accept Housing Choice Vouchers, so seniors will need to check with the senior apartment facility to determine whether it participates in the program.

For those needing permanent supportive housing, consider contacting the Community Assistance Center, which combines housing aid, case management, and supportive services to encourage self-sufficiency and enhance proficiency in tenancy skills.

Seniors can also use their Social Security benefits to cover living expenses, including rent. Different Social Security benefits can be used for housing, all with varying eligibility requirements:

For those who need guidance or advocacy, the Texas Aging and Disability Resource Center provides help to seniors and their families and can talk you through all your options regarding public assistance.

Understand Texas laws and regulations for senior apartments communities

Senior apartments that don’t offer health services do not need to be regulated like other senior communities (under the Texas Health and Human Services Commission). Instead, seniors are protected under the county, state, and federal laws for renters.

Rental properties are not required to be inspected before a tenant moves in. However, landlords must make necessary repairs to ensure the property is safe and habitable. Federal laws to be aware of include:

  • The Fair Housing Act prohibits housing discrimination based on familial status, disability, race, nationality, religion, and sex. The Housing for Older Persons exemption, part of the Fair Housing Act, guarantees that only approved housing is available for people over 55.
  • The Americans With Disabilities Act (ADA) mandates that senior apartments must provide adequate accessibility, including common areas, and prohibits discrimination against individuals with disabilities.
  • The U.S. Department of Housing and Urban Development (HUD) has laws specifically for Section 8 of the Housing Act, which protects tenants. Most senior living apartments require tenants to be over 55 under the Fair Housing Act, and some have higher age minimums.

Locally, there are additional laws that protect renters, such as:

  • The Texas Property Code outlines the landlord’s and tenant’s rights and responsibilities regarding leases, rent payments, security deposits, and repairs. For example, it protects tenants from retaliation by landlords if they report code violations or assert their rights as renters.
  • The Montgomery County Fair Housing Ordinance is similar to the federal Fair Housing Act but includes additional protected classes such as age, marital status, and sexual orientation.

You can find more information on Texas’ landlord/tenant laws and tenants’ rights in this Landlord/Tenant Law guide.

Though there are currently no COVID-19 regulations for senior apartments in The Woodlands and Montgomery County, general guidelines may vary depending on the specific apartment complex. Vaccines are not required, and Executive Order GA-40 prohibits any entity in Texas from requiring individuals to get a COVID-19 vaccine.

Individuals who exhibit symptoms of COVID-19, have tested positive for the virus, or have come into close contact with someone who has COVID-19 are advised to wear a high-quality mask or respirator while in public indoor settings. Executive Order GA-38 prohibits governmental entities and officials from requiring masks.
