How do I protect my home if I put my husband in a rest home? He has alzheimers.

Your home remains exempt if you continue to live there – it will not be counted for Medicaid purposes.

In many states, the homeplace is excluded from resources for Medicaid eligibility but not necessarily for estate recovery after your husband dies. In my state, Georgia, putting the house in your name will allow you to avoid estate recovery not just during your lifetime, but forever.

There may be options available to you depending on where you live and the other resources you and your husband have. In general, a home where a healthy spouse lives is an “exempt resource” in Medicaid planning. I recommend you seek out a local elder law attorney or other elder support resources in your community for further guidance.

They cannot take your home as long as you live in it.
